| 内容記述 | This paper studies the judicial review of law-making process of the Diet. Such review is necessary and useful particularly for election and law. The reason is because lawmaking process concerning election tends to reflect vested interests of sitting members of the Diet. Is the judicial power able to review lawmaking process of the Diet? If possible, how does a court review law-making process? What method? What are standards of the review? The Supreme Court decision-Koshiyama v. Central Election Management Council, 1849 Hanrei Jiho 9 (Sup. Ct., Jan.14, 2004) can contribute to a useful material of consideration of the review. | |||||
